These Terms of Service (“Terms”) constitute a legally binding agreement between you and Engager Global LLC (“Engager Global,” “we,” “us,” or “our”) governing your access to and use of the website at engagerglobal.com and all related services, features, and content (collectively, the “Services”).

By accessing or using our Services — including browsing the Site, submitting an application, or engaging our advisory services — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our Services.

You must be at least 18 years of age to use our Services.

2. Use of the Site

You may use our Site and Services for lawful purposes only and in accordance with these Terms. You agree not to:

3. Application Process

You may submit applications for the Affiliate Growth Program, Capital Matchmaking, or ecosystem partner routing through our Site. By submitting an application, you acknowledge and agree that:

• Submitting an application does not guarantee acceptance into any program or receipt of any service.
• We reserve the right to accept or decline any application at our sole discretion.
• Application information you provide must be accurate, truthful, and not misleading.
• Acceptance into a program may be subject to a separate service agreement with specific terms, fees, and deliverables.

4. Advisory & Matchmaking Services

Engager Global provides consulting, advisory, and matchmaking services to wellness brands. These services include affiliate program management through the Perhaps network, capital readiness analysis, capital program matching, and ecosystem referrals.

Services are provided on a project or retainer basis under separate service agreements. Nothing in these Terms creates an obligation by Engager Global to provide any specific service unless explicitly agreed in writing.

5. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of Engager Global LLC or its licensors and is protected by US and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any content on our Site without our prior written consent, except to print or download a reasonable number of pages for your own personal, non-commercial reference.

6. Disclaimers

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ENGAGER GLOBAL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted or error-free, or that any program matching will result in financing, capital, or affiliate revenue.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ENGAGER GLOBAL LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE OR SERVICES, EVEN IF ENGAGER GLOBAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR AGGREGATE LIABILITY TO YOU EXCEED $100 OR THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

These Terms and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive personal jurisdiction of the state and federal courts located in California for the resolution of any disputes.
